Scope of Terms and Conditions

(1) These General Terms and Conditions apply to contracts for the temporary rental of holiday apartments for accommodation purposes, as well as to all additional services and deliveries provided by Klaus Walterbusch to the guest. All services are rendered exclusively on the basis of these Terms and Conditions.

(2) The subletting or transfer of the provided apartment, as well as its use for purposes other than accommodation, requires our prior written consent.

(3) The guest's own terms and conditions apply only if explicitly agreed upon in writing by us.

§ 1 Definitions

a) “Haus am Iberg”, “we”, “us” or “our” refers to Klaus Walterbusch.

b) “Klaus Walterbusch” refers to the website www.haus-am-iberg.de.

c) “Services” refers to all services provided by Klaus Walterbusch, including but not limited to processing booking requests, handling payments, managing reservations, and operating third-party content via our channel manager.

d) “Customer” refers to: a) the person registering on their own behalf; or b) the organization whose authorized representative creates a customer account.

e) “Customer account” means the account created by the customer at www.haus-am-iberg.de to access and use the services.

f) “Property” refers to any accommodation, apartment, boat, house or rental unit offered via the services, whether directly or via a third party channel.

g) “Content” includes text, graphics, images, music, software, audio, video, and other forms of data.

h) “Customer content” means any content provided by the customer while using the services, including but not limited to descriptive or promotional material.

§ 2 Booking / Booking Confirmation

All booking requests must be made via our website www.haus-am-iberg.de, by email to info@haus-am-iberg.de or by telephone at +49 176 87801446. Requests made through any other means will not be considered.

If the desired holiday apartment is available for the requested period, you will receive a written booking confirmation and an invoice via email or post. Upon receipt of the booking confirmation and the deposit payment (see § 3 Payment Terms), the booking becomes legally binding.

§ 3 Payment Terms

The booking becomes valid upon receipt of full payment. Payment must be made within 5 days of receiving the booking documents. If payment is not received on time, Klaus Walterbusch reserves the right to withdraw from the contract. Non-payment is considered a cancellation and entitles us to re-rent the apartment.

§ 4 Arrival and Departure

On the day of arrival, the apartment is available from 4:00 PM. You will receive information about key collection by phone or email one day prior to your arrival. Delays in availability do not entitle you to compensation.

On the day of departure, the apartment must be vacated by 10:00 AM. Late departures require prior arrangement and will otherwise be charged additionally.

No (partial) refunds will be given for early departures.

The apartment must be left swept clean. Dishes, glasses etc. must be cleaned and stored, trash bins emptied, and the fridge cleared out. If the apartment is not left in this condition, a cleaning fee may be charged.

§ 5 Holiday Apartments

The holiday apartment is handed over in a clean and orderly condition with complete inventory. If you notice any deficiencies during your stay, you are obliged to notify Klaus Walterbusch immediately. The guest is liable for all damages caused by them to the rental property, its furnishings, or keys.

The inventory must be handled with care and is intended solely for use within the apartment. Rearranging furniture, especially beds, is not permitted. The guest is also liable for the actions of their companions. Damages caused by force majeure are excluded.

In the event of a breach of contract—such as subletting, exceeding occupancy limits, or disturbing the peace—we reserve the right to terminate the contract without notice. In such cases, there is no entitlement to a refund.

§ 6 Pets

Pets are only permitted in Apartment 2 and only with prior written approval from the provider. The tenant is fully liable for any damage caused by the pet. Please notify us immediately if your pet causes any damage.

Pets are not allowed on beds or upholstered furniture. Any mess caused by the pet must be cleaned up by the tenant. Frequent or continuous barking must not disturb neighbors. A fee of €20 per pet applies.

If pets are brought without prior approval, a cleaning fee of €50 will be charged for Apartment 2 and €100 for all other apartments.

§ 7 Stay

The holiday apartment may only be used by the persons listed in the booking. If additional persons stay overnight, a surcharge of €50 per person per night will apply. Klaus Walterbusch reserves the right to terminate the rental agreement without notice in such cases.

Subletting or transferring the apartment to third parties is not permitted. By making payment, the guest agrees to the General Terms and Conditions and the house rules.

In case of violations of these conditions, Klaus Walterbusch is entitled to terminate the rental agreement without notice. No refund of the rental fee will be granted in such cases.

§ 8 Cancellation Policy

Cancellations must be made in writing. In case of cancellation, the guest is required to pay a portion of the agreed rental price as compensation. The amount depends on the time of cancellation before the scheduled arrival date:

  • up to 42 days before arrival: free of charge
  • from 41 days before arrival: 80% of the agreed price
  • in case of no-show: 100% of the agreed price

§ 9 Cancellation by the Host

If Klaus Walterbusch is unable to provide the booked accommodation due to force majeure or unforeseen circumstances (e.g. illness or accident of the host), liability is limited to the refund of any payments already made. No further claims, especially for travel or hotel expenses, will be accepted.

§ 11 Permission to Use Internet Access via WLAN

Klaus Walterbusch provides guests with WLAN access for the duration of their stay. Tenants are not permitted to share access with third parties. There is no entitlement to any specific speed, availability, or functionality of the internet connection.

In cases of unlawful or abusive use, we reserve the right to block access entirely or partially.

§ 11.1 Access Credentials

The WLAN connection is password-protected. Login credentials (username and password) may not be shared with third parties. If access is to be granted to others, prior written approval from Klaus Walterbusch is required. Guests are obligated to keep their access credentials confidential. The host reserves the right to change the login credentials at any time.

§ 11.2 Risks of WLAN Usage, Limitation of Liability

Guests are expressly advised that use of the WLAN is at their own risk. No security measures such as antivirus or firewalls are provided. Data transmission is unencrypted and may be intercepted by third parties. There is a risk of malware infecting guest devices. Klaus Walterbusch accepts no liability for damages to tenant devices unless such damages are caused intentionally or by gross negligence on the part of the host or his agents.

§ 12 House Rules, General Rights and Duties

(1) Guests must comply with the house rules. Quiet hours apply between 10:00 PM and 7:00 AM. To avoid disturbing others, TV and audio devices must be kept at room volume. Music is not permitted in outdoor areas.

(2) During the rental period, guests are required to keep windows and doors closed when leaving the apartment.

(3) Smoking is strictly prohibited inside the apartment. In case of violation, a cleaning fee of up to €100 may be charged. Smoking is permitted on balconies and terraces.

§ 13 Place of Jurisdiction

The local court in Korbach shall have jurisdiction over all disputes arising from this contractual relationship.
